Integral membrane proteins are found in all cellular membranes and fulfil many of the functions that are central to life. A critical step in the biosynthesis of membrane proteins is their insertion into the lipid bilayer. The mechanisms of membrane protein insertion and folding are becoming increasingly better understood, and efficient methods for the ab initio prediction of three‐dimensional protein structure from the primary amino acid sequence may be within reach. The progress of electronic health technologies and biobanks holds enormous promise for efficient research. Evidence shows that studies based on sharing and secondary use of data/samples have the potential to significantly advance medical knowledge. However, sharing of such resources for international collaboration is hampered by the lack of clarity about ethical and legal requirements for transfer of data and samples across international borders. Here, the International Clinical Trial Center Network reports the legal and ethical requirements governing data and sample exchange (...) across four continents. The most recurring requirement is ethical approval, whereas only in specific conditions approval of national health authorities is required. Informed consent is not required in all sharing situations. However, waiver of informed consent is only allowed in certain countries/regions and under certain circumstances. The current legal and ethical landscape appears to be very complex and under constant evolution. Regulations differ between countries/regions and are often incomplete, leading to uncertainty. With this work, ICN illuminates the unmet need for a single international collaborative framework to facilitate DSE. Harmonising requirements for global DSE will reduce inefficiency and waste in research. There are many challenges to realising this ambitious vision, including inconsistent terminology and definitions, and heterogeneous and dynamic legal constraints. Here, we identify areas of agreement and significant difference as a necessary first step towards facilitating international collaboration. We propose the establishment of a working group to continue the comparison across jurisdictions, create a standardised glossary and define a set of basic principles and fundamental requirements for DSE. An early-fifth century inscription from Central Cretan Gortyn allowed freedmen to take residence in a place called Latosion and granted them protection from being robbed and enslaved. Furthermore, the inscription obligated a number of polis-institutions to persecute those who might violate this regulation. The first part of this paper argues for a new reading and interpretation of this inscription, which have considerable consequences for our understanding of how Archaic Cretan institutions cooperated and how they were controlled by the polis. Das thermische Material erscheint vor dem Hintergrund realer Kunstentwicklung und traditioneller philosophischer Ästhetik (Kant, Hegel, Warburg, Adorno) denkbar ungeeignet für die künstlerische Verwendung: Zu unerheblich mutet das expressive Potential aufgrund geringer Formbarkeit an und allzu sehr erschwert die Unmittelbarkeitswahrnehmung durch die Haut den Transfer ins Ideelle, Geistige oder Metaphorische. Die Studie zeigt hingegen, dass der Bruch mit dem Visualitätsparadigma eine Reihe von unterschiedlichen Aneignungsstrategien des Thermischen hervorgebracht und zu funktionsvariabler Verwendung im ästhetischen Gesamtzusammenhang geführt hat: illustrative, affektive, indexikalische, mythische, utopische, (...) sinnlichkeitsschulende, assoziative und kritische Funktion werden im Kunstwerk zur Geltung gebracht. Trotz der semantischen Verfügbarmachung zeigt das thermische Moment eine Widerständigkeit gegen die Intellektualisierung, was eine tiefergehende Kenntnisnahme durch die Kunstwissenschaft und Kunstkritik bisher verhindert hat. In zwei historischen Exkursen zur Romantik und zum Ästhetizismus um 1900 wird die These vertreten, dass als Voraussetzung für thermo-künstlerische Wahrnehmung ein auf Sinnlichkeit orientiertes Subjekt angenommen werden muss. Allerdings geniesst dieser Subjekttypus in der Tradition einer auf Reflexion ausgerichteten Kunstphilosophie keine besondere Wertschätzung. ZusammenfassungIn Umsetzung der EU-Verordnung Nr. 536/2014 hat der deutsche Gesetzgeber mit § 40b Abs. 4 AMG die gruppennützige Arzneimittelforschung mit Nichteinwilligungsfähigen zugelassen, sofern der Proband zuvor in einwilligungsfähigem Zustand nach den Regeln der Patientenverfügung darin eingewilligt hat. Die Anwendungsvoraussetzungen schließen forensische Psychiatriepatienten nicht aus, obgleich das kategorische Verbot für zwangsweise Untergebrachte formell-rechtlich unverändert geblieben ist. Damit stellt sich die praxisrelevante Frage nach dem rechtssystematischen Verhältnis der neuen Erlaubnis zum bisherigen Verbot – und letztlich zu den Perspektiven einer angemessenen Arzneimittelversorgung von (...) This paper concerns the semantic difference between strong and weak neces-sity modals. First we identify a number of explananda: their well-known in-tuitive difference in strength between ‘must’ and ‘ought’ as well as differ-ences in connections to probabilistic considerations and acts of requiring and recommending. Here we argue that important extant analyses of the se-mantic differences, though tailored to account for some of these aspects, fail to account for all. We proceed to suggest that the difference between ’ought’ and ’must’ lies (...) in how they relate to scalar and binary standards. Briefly put, must(φ) says that among the relevant alternatives, φ is selected by the relevant binary standard, whereas ought(φ) says that among the relevant al-ternatives, φ is selected by the relevant scale. Given independently plausi-ble assumptions about how standards are provided by context, this ex-plains the relevant differences discussed. (shrink)

Thomas Kuhn, Paul Feyerabend und Imre Lakatos kritisieren Poppers Wissenschaftsauffassung mit den Argumenten, dass die Erfahrung keine sichere Grundlage für Falsifikationen von Theorien gibt, und dass falsifizierte Theorien in der Wissenschaftsgeschichte selten vollständig aufgegeben werden. Es wird gezeigt, dass eine kritische Diskussion von fehlbaren Prüfsätzen möglich ist, und dass es nicht notwendig ist, falsifizierte Theorien vollständig aufzugeben. Mit diesen Argumenten kann Kuhns, Feyerabends und Lakatos’ Kritik zurückgewiesen werden.

We defend a contextualist account of deontic judgments as relativized both to (i) information and to (ii) standards or ends, against recent objections that turn on practices of moral disagreement. Kolodny & MacFarlane argue that information-relative contextualism cannot accommodate the connection between deliberation and advice; we suggest in response that they misidentify the basic concerns of deliberating agents. For pragmatic reasons, semantic assessments of normative claims sometimes are evaluations of propositions other than those asserted. Weatherson, Schroeder and others have raised (...) parallel objections to standard-relative contextualism; we argue for a parallel solution. (shrink)

Recently, contextualism about epistemic modals and predicates of taste have come under fire from advocates of assessment relativistic analyses. Contextualism, they have argued, fails to account for what we call "felicitous insensitive assessments". In this paper, we provide one hitherto overlooked way in which contextualists can embrace the phenomenon by slightly modifying an assumption that has remained in the background in most of the debate over contextualism and relativism. Finally, we briefly argue that the resulting contextualist account is at least (...) as plausible as the relativist alternative and should be carefully considered before contextualism is abandoned for relativism. Recent work in experimental philosophy shows that folk intuitions about moral responsibility are sensitive to a surprising variety of factors. Whether people take agents to be responsible for their actions in deterministic scenarios depends on whether the deterministic laws are couched in neurological or psychological terms (Nahmias et. al. 2007), on whether actions are described abstractly or concretely, and on how serious moral transgression they seem to represent (Nichols & Knobe 2007). Finally, people are more inclined to hold an agent (...) responsible for bringing about bad than for bringing about good side effects that the agent is indifferent about (Knobe 2003). Elsewhere, we have presented an analysis of the everyday concept of moral responsibility that provides a unified explanation of paradigmatic cases of moral responsibility, and accounts for the force of both typical excuses and the most influential skeptical arguments against moral responsibility or for incompatibilism. In this article, we suggest that it also explains the divergent and apparently incoherent set of intuitions revealed by these new studies. The climb of Gasherbrum IV’s (7,925 m) ‘Shining Wall’ in 1985 by Voytek Kurtyka and Robert Schauer is considered one of the greatest mountaineering achievements in the twentieth century, even though the two climbers did not reach the summit. The article explores three ways of understanding mountaineering without the objective of reaching the summit. I start with a game-playing approach and then a view on mountaineering that takes its inspiration from deep ecology and argue that while both have the potential (...) for explaining important aspects of mountaineering, neither will fully account for the value of climbing mountains without summiting. Finally, I argue that we can supplement either of these two views with a radically different way of understanding mountaineering, which involves creating and appreciating a work of art. (shrink)

In a metaphorical sense, a thing is complex if it comprehends a magnitude of homogeneous or different things. However, it depends on the kind of comprehension, if we conceive something that consists of many things as complex or not. It is perhaps most distinctive for complex phenomena that their properties and behavior aren't reducible to the properties and behavior of their elements. This poses some challenging metaphysical problems. Alva Noë’s strategy to solve the puzzle of perceptual presence entirely relies on the principle of presence as access. Unaccessed or unattended parts or details of objects are perceptually present insofar as they are accessible, and they are accessible insofar as one possesses sensorimotor skills that can secure their access. In this paper, I consider several arguments that can be opposed to this claim and that are chiefly related to the modal status of action, i.e. the fact that the action (...) that would secure access to the absent aspects is a possibility, something that can be done. The main difficulty Noë’s account must face is –as several situations demonstrate– that the action that should be performed for the absent aspects to be actually accessed does not have to be itself available for these aspects to be perceptually present. What matters for the absent aspects to be present is not their de facto accessibility, but their de jure accessibility. To overcome those difficulties, I propose to rely on a ternary model of the role of action possibilities in perceptual awareness. This model builds on Husserl’s analysis of the role of perceptual circumstances in perception and connection between sense registering and horizontal intentionality. (shrink)

There’s a general assumption that teleology and function do not exist in inanimate nature. Throughout biology, it is generally taken as granted that teleology (or teleonomy) and functions are not only unique to life, but perhaps even a defining quality of life. For many, it’s obvious that rocks, water, and the like, are not teleological, nor could they possibly have stand-alone functions. This idea - that teleology and function are unique to life - is the target of this paper. I (...) begin with an overview of McShea’s field theoretic account of teleology. I start with the field theoretic account because it presents a promising analysis of teleological systems. It is promising because, in not making any assumptions about life’s special status in teleological systems, it avoids counterexamples that have problematized other accounts. I then consider some of the prominent efforts that have been made to attempt to avoid ascribing functions or teleology to some form of inanimate nature. In my assessment, none of the efforts are successful. I conclude by offering mineral evolution as a case study to show how inanimate nature can be both teleological and functional. The evolution of mineral species reveals that teleology and function extend to inanimate nature, and that teleology and function come in degrees. (shrink)

Teleology has a complicated history in the biological sciences. Some have argued that Darwin’s theory has allowed biology to purge itself of teleological explanations. Others have been content to retain teleology and to treat it as metaphorical, or have sought to replace it with less problematic notions like teleonomy. And still others have tried to naturalize it in a way that distances it from the vitalism of the nineteenth century, focusing on the role that function plays in teleological explanation. No (...) consensus has seemed possible in this debate. This paper takes a different approach. It argues that teleology is a perfectly acceptable scientific notion, but that the debate took an unfortunate misstep some 2300 years ago, one that has confused things ever since. The misstep comes in the beginning of Aristotle’s Physics when a distinction is made between two types of teleological explanation. One type pertains to artifacts while the other pertains to entities in nature. For Aristotle, artifacts are guided by something external to themselves, human intentions, while natural entities are guided by an internal nature. We aim to show that there is, in fact, only one type of legitimate teleological explanation, what Aristotle would have considered a variant of an artifact model, where entities are guided by external fields. We begin with an analysis of the differences between the two types of explanation. We then examine some evidence in Aristotle’s biological works suggesting that on account of his natural-artifactual distinction, he encountered difficulties in trying to provide teleological accounts of spontaneous generation. And we show that it is possible to resolve these difficulties with a more robust version of an artifact model of teleology, in other words, with an externalist teleology. This is McShea’s model, in which goal-directed entities are guided by a nested series of upper-level fields. To explain teleological behavior, this account invokes only external physical forces rather than mysterious internal natures. We then consider how field theory differs from other efforts to naturalize teleology in biology. And finally, we show how the account enables us to grapple with certain difficult cases – genes and intentions – where, even in biology today, the temptation to posit internal natures remains strong. This paper argues that the account of teleology previously proposed by the authors is consistent with the physical determinism that is implicit across many of the sciences. We suggest that much of the current aversion to teleological thinking found in the sciences is rooted in debates that can be traced back to ancient natural science, which pitted mechanistic and deterministic theories against teleological ones. These debates saw a deterministic world as one where freedom and agency is impossible. And, because teleological (...) entities seem to be free to either reach their ends or not, it was assumed that they could not be deterministic. Mayr’s modern account of teleonomy adheres to this basic assumption. Yet, the seeming tension between teleology and determinism is illusory because freedom and agency do not, in fact, conflict with a deterministic world. To show this, we present a taxonomy of different types of freedom that we see as inherent in teleological systems. Then we show that our taxonomy of freedom, which is crucial to understanding teleology, shares many of the features of a philosophical position regarding free will that is known in the contemporary literature as ‘compatibilism’. This position maintains that an agent is free when the sources of its actions are internal, when the agent itself is the deterministic cause of those actions. Our view shows that freedom is not only indispensable to teleology, but also that, contrary to common intuitions, there is no conflict between teleology and causal determinism. (shrink)

The purpose of this paper is to demonstrate the usefulness of the concept of possibility , and not merely that of actuality , for an inquiry into the bodily constitution of experience. The paper will study how the possibilities of action that may (or may not) be available to the subject help to shape the meaning attributed to perceived objects and to the situation occupied by the subject within her environment. This view will be supported by reference to empirical evidence (...) provided by recent and current research on the perceptual estimation of distances and the effects brought about by the use of a tool on the organisation of our perceived immediate space. What kind of a science is psychoanalysis? What constitutes its domain? What truth claims does it maintain? In this unique and scholarly work concerning the nature of psychoanalysis, Gunnar Karlsson guides his arguments through phenomenological thinking which, he claims, can be seen as an alternative to the recent attempts to cite neuropsychoanalysis as the answer to the crisis of psychoanalysis. Karlsson criticizes this effort to ground psychoanalysis in biology and neurology and emphasizes instead the importance of defining the psychoanalytic (...) domain from the vantage point of the character of consciousness. His understanding of the unconscious, the libido and the death drive offer new insights into the nature of psychoanalysis, and he also illuminates and develops neglected dimensions such as consciousness and self-consciousness. Karlsson's approach to psychoanalysis is rigorous yet original, and this book fills an intellectual gap with implications for both the theoretical understanding and clinical issues of psychoanalysis. ABSTRACTThe aim of this narrow-focused text is to argue against the claim that the appresentation of unperceived features of objects that is implied in perceptual intentionality presupposes a reference to perceptions other subjects could have of these objects. This claim, as it has been defended by Dan Zahavi, rests upon an erroneous supposition about the modal status of the perceptual possibilities to which the perceived object refers, which shall not be interpreted as effectively realizable but as mere de jure possibilities, (...) perceptions that could have been realized in principle, but that are maybe beyond one’s reach considering one’s concrete factual powers and opportunities. Horizontal intentionality is better accounted for in terms of perceptions that one could have had because of one’s embodied character and the always open possibility of occupying another position with respect to the object. For Husserl, kinaesthetic capability is a key piece of the process of perception. By ensuring the junction between the actual and the potential, it allows the exhibition of an object that is always more than what appears. Kinaesthetic capability preserves the transcendence of the object by preventing the phenomenon from being confined to pure actuality. This idea, however, poses significant challenges when one questions the nature of the possibilities that are at stake here. Especially, the perceived seems to enjoy a (...) kind of emancipation from these capabilities as they actually are. How can one justify that the structures of the perceived world are the intentional correlate of the kinaesthetic skills of the subject if such structures continue to regulate the sense of the appearing objects when those skills are neutralized? We will see that only a genetic perspective, assuming the intrinsically historical character of the subject, provides a satisfactory answer to this question, and that this perspective leads to placing into question the actualist position that Husserl sometimes tends to adopt.
